1. Scope and who we are

This Privacy Policy explains how SmartHiring Ltd ("Smart Hiring", "we", "us" or "our") collects, uses, stores, shares and protects personal data when you visit smarthiring.com, create an account, purchase a subscription, invite candidates, take an assessment, use our application programming interface, or contact us.

We operate a psychometric assessment platform used by employers and HR teams to evaluate candidates. We are the Data Fiduciary for account, billing and website data. When an employer invites a candidate to take a test, we process that candidate's assessment data in order to deliver the service the employer has purchased, and we share the resulting scores and reports with that employer.

This policy should be read with our Terms and Conditions, Cookie Policy and Return Policy. If you do not agree, please do not use the website or services.

2. Data Fiduciary and contact details

SmartHiring Ltd is the Data Fiduciary for personal data processed through this website, except where we process data solely on the documented instructions of an employer or integrator using our white-label services.

3. Personal data we collect

The data we collect depends on how you use the platform:

Account and identity data

Name, email address, phone number, company name, designation, GST number (if you provide one), and billing or office address.

Candidate and assessment data

Candidate name, email, phone number, test invitations, answers, time spent, consistency checks, trait scores, SAT or custom-test results, and AI-generated hiring reports derived from those answers.

Payment and transaction data

Order ID, Razorpay payment and refund references, amount, currency (INR), plan type, coupon codes, invoice details and payment status. We do not collect or store complete card numbers, CVV, UPI PIN or internet-banking passwords. Those are handled by Razorpay.

Technical, device and test-integrity data

IP address, browser type, device type, operating system, session identifiers, and events used to protect test integrity (for example leaving fullscreen, switching tabs, or using an unsupported device), where those controls are enabled for a session.

Communications

Support requests, emails, form submissions and related correspondence.

What we do not collect: we do not ask for caste, religion, political opinions, biometric templates, or health records. Personality-trait scores are occupational assessment outputs, not medical diagnoses. We do not use webcam recording unless a future feature is clearly disclosed before a test starts.

4. How data is collected

Directly from you

Registration, profile forms, checkout, support emails, and candidate test-taking.

From the inviting employer

HR users enter candidate name, email and related invite details so we can send a test link and return results to that employer.

Automatically

Cookies, session tokens, server logs and test-integrity events, as described in our Cookie Policy.

Payment provider

Razorpay confirms payment success, failure, refunds and related transaction references.

5. Purposes of processing

We process personal data to:

  • Create and manage accounts and subscriptions.
  • Deliver psychometric, SAT and custom assessments.
  • Generate scores, reports and AI hiring briefs for the inviting employer.
  • Process payments, invoices, refunds and tax records in Indian Rupees.
  • Send service emails (invites, results, password resets, billing).
  • Protect test integrity, prevent fraud and secure the platform.
  • Provide customer support and investigate complaints.
  • Comply with Indian law, including tax, accounting and payment-aggregator record-keeping.
  • Improve the website and assessments, using aggregated or de-identified information where practicable.

We will not use personal data for a new purpose that is unrelated to the above without a fresh notice and, where required, consent, unless the law permits or requires it.

6. Consent, candidate visibility and sharing

Consent

Where consent is required under the Digital Personal Data Protection Act, 2023, we will request it through a clear notice. You may withdraw consent by emailing Info@smarthiring.com. Withdrawal does not affect processing already completed lawfully, and may mean we cannot continue a service (for example, we cannot issue an assessment report without processing answers).

Sharing with the inviting employer

Candidate answers, scores and reports are shared with the employer or integrator who initiated the assessment. We do not publish a candidate's resume, phone number or test answers on a public job board. Employers must use candidate data only for legitimate hiring evaluation and must not sell it.

Processors and other recipients

We may share relevant data with:

  • Razorpay and its facility providers, for payment processing and refunds.
  • Email delivery providers, for transactional mail.
  • Cloud hosting and infrastructure providers.
  • The AI model provider used to generate hiring reports from assessment data.
  • Cloudflare Turnstile or similar, for bot protection on public forms.
  • Professional advisers, auditors and insurers.
  • Government authorities, courts or law-enforcement agencies where legally required.
  • A successor entity in a merger or business transfer, with lawful safeguards.

7. Razorpay and payments

Payments are processed by Razorpay, an RBI-authorised payment aggregator. Razorpay may collect and process payment-instrument data under its own privacy policy and terms. We retain our own order, payment ID, amount, status and refund records. We do not request or store complete card credentials or UPI PINs.

8. Cookies

We use cookies and similar technologies for login, security, preferences and (during checkout) payment. Details are in our Cookie Policy. You can control cookies in your browser; blocking essential cookies may prevent sign-in or test-taking.

9. Security and cross-border processing

We use reasonable technical and organisational safeguards, including access controls, encrypted transport (HTTPS), hashed passwords, restricted staff access and vendor due diligence. No electronic system is completely secure. If a security incident occurs, we will investigate, contain it, and provide any notification required by law.

Some processors (including AI analysis and certain cloud or email services) may be located outside India. We transfer personal data outside India only in accordance with the Digital Personal Data Protection Act, 2023 and rules made under it.

10. Retention

We keep personal data only as long as needed for the purposes above, including dispute resolution, fraud prevention and legal obligations.

  • Account and assessment records: for the life of the customer account and a reasonable period afterwards so employers can retrieve historical reports.
  • Payment and tax records: typically eight (8) years under Indian tax law, and up to ten (10) years where payment-aggregator or contractual record-keeping requires it.
  • Test-integrity logs: for a limited period needed to investigate suspected misuse, then deleted or aggregated.

11. Your rights

Subject to the Digital Personal Data Protection Act, 2023, you may request:

  • A summary of personal data we hold about you and the processing activities.
  • Correction of inaccurate or incomplete data.
  • Erasure, where retention is not required by law or for the original purpose.
  • Withdrawal of consent, where processing is consent-based.
  • Grievance redressal as described below.

Send requests to Info@smarthiring.com from the email address associated with your account, with enough detail for us to verify your identity. Employers who invited a candidate may need to handle certain candidate requests themselves where they determine the hiring purpose.

12. Children

The platform is intended for adults and for employers assessing adult candidates. We do not knowingly collect personal data from children under 18. If you believe we have done so, write to Info@smarthiring.com and we will delete the data unless the law requires us to keep it.

We aim to acknowledge grievances within two (2) business days and resolve them within thirty (30) days, or such period as applicable law requires. You may also have the right to approach the Data Protection Board of India after exhausting this process.

14. Changes

We may update this Privacy Policy to reflect changes in our services, technology or the law. The current version will be posted on this page with a revised effective date. Continued use after publication constitutes notice of the updated policy.
