Please read these terms carefully before using Smart Hiring or making a payment.

Electronic record
This document is an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and does not require any physical or digital signature. It is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, insofar as they apply.
1. About Smart Hiring and acceptance
Smart Hiring is operated by SmartHiring Ltd, having its office at E 172, 1st Floor, New Ashok Nagar, New Delhi, 110096, India. We provide an online psychometric assessment platform, including 15-trait personality assessments, SAT and critical-reasoning tests, custom tests, AI-generated hiring reports, and related digital tools for employers and HR teams.
By accessing the website, creating an account, submitting information or making a payment, you agree to these Terms and Conditions, the Privacy Policy, the Return Policy, the Shipping and Delivery Policy and the Cookie Policy. If you do not agree, you must not use the website or purchase services.
We may update these terms by posting a revised version on this page. Continued use after publication constitutes acceptance. The exact plan features, fees, quotas and validity period are those displayed at checkout, on the pricing page, or in your order confirmation.
2. Eligibility and accounts
Eligibility
You confirm that:
- You are at least 18 years old and competent to contract under the Indian Contract Act, 1872.
- Information you submit is accurate and current.
- If you act for a company, you have authority to bind that organisation.
Account responsibilities
Keep login credentials confidential. You are responsible for activity under your account. Notify us promptly at Info@smarthiring.com if you suspect unauthorised access. Sharing a paid account outside your organisation is prohibited.
Prohibited conduct
- Creating an account with false information.
- Misrepresenting a candidate's identity or allowing another person to take a test on a candidate's behalf.
- Copying, reverse-engineering, scraping or republishing our questions, scoring models or reports.
- Circumventing payment, access-control or test-integrity measures.
- Using the platform for fraud, spam, harassment or unlawful discrimination.
3. Nature of the service
Smart Hiring is a decision-support tool. Unless we expressly promise otherwise in writing:
- We do not guarantee that an employer will hire any candidate.
- We do not guarantee a particular number of interviews, offers or retained employees.
- Assessment scores describe response patterns; they are not medical, psychiatric or legal advice.
- AI-generated reports are assistive summaries of scored data and may contain errors; employers must apply human judgement.
- We are not the candidate's employer and we are not a recruitment or staffing agency.
Employers remain solely responsible for their hiring decisions, compliance with labour and anti-discrimination law, and how they use reports.
4. Fees, taxes and Razorpay
Prices
Prices are shown in Indian Rupees (INR). GST and other taxes will be charged as applicable under Indian law and shown at checkout or on the invoice. You agree to pay the amount displayed before you confirm payment.
Payment processing
Payments are processed through Razorpay or another authorised provider. We do not ordinarily receive or store complete card numbers, CVV, UPI PIN or internet-banking credentials. Payment remains subject to Razorpay's terms. A payment is successful only after we receive confirmation from the payment gateway.
Failed or duplicate payments
If an amount is debited but the order is not confirmed, contact us at Info@smarthiring.com with the payment reference, date and amount. We will verify the transaction with Razorpay. If we received the amount but did not activate the service, we will activate it or process an eligible refund under our Return Policy. If the charge is only blocked or pending, your bank or UPI app may reverse it on its own timeline.
5. Intellectual property and user content
Our content
All branding, question banks, scoring logic, software, reports, graphics and other content on the platform belong to SmartHiring Ltd or its licensors. You receive a limited, non-exclusive, non-transferable right to use purchased assessments and reports for your internal hiring purposes during the subscription period.
Restrictions
You must not copy, resell, publish, train models on, or commercially exploit our materials without written permission.
Your content
You grant us permission to use names, job details, candidate contact data and assessment responses only as needed to provide the service, maintain records, prevent fraud and comply with law. You confirm you have the right to submit that information.
6. Disclaimers
The platform is provided on an "as available" basis. To the maximum extent permitted by Indian law, we do not warrant that:
- The website will be uninterrupted, error-free or free of harmful code.
- Every score, report or AI summary will be complete or perfectly accurate.
- A hiring outcome will occur.
Nothing in these terms excludes liability that cannot legally be excluded, including liability for fraud, wilful misconduct, or statutory consumer rights under the Consumer Protection Act, 2019.
7. Limitation of liability and indemnity
Limitation
To the extent permitted by law, our aggregate liability arising from a particular paid order will not exceed the amount actually paid to us for that order. We will not be liable for indirect, incidental, special or consequential loss, including loss of profit, business, goodwill or employment opportunity, except where such exclusion is prohibited.
Indemnity
You agree to indemnify SmartHiring Ltd, its officers and service providers against claims, losses, penalties and reasonable expenses arising from your breach of these terms, submission of unlawful content, misuse of candidate data, or fraudulent use of the services.
8. Suspension and termination
We may suspend or terminate an account if you breach these terms, payment is reversed or fraudulent, you misuse personal data, or a payment provider or authority requires it. Termination does not affect accrued payment obligations or clauses intended to survive (intellectual property, limitation of liability, indemnity, governing law).
Refunds, if any, follow the Return Policy.
9. Governing law and disputes
These terms are governed by the laws of India. The parties will first attempt to resolve disputes in good faith. If unresolved, disputes are subject to the exclusive jurisdiction of the courts at New Delhi, India, unless applicable consumer law provides otherwise.
